OFFICIAL RULES: Northern New England Journey® Photo Contest 2020

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.

1. ELIGIBILITY
Entrants must be legal residents of Maine, New Hampshire, or Vermont who are 18 years of age or older as of June 1, 2020, and members in good standing of AAA Northern New England as of February 15, 2020 (each, an “Entrant”), to enter the Northern New England Journey 2020 Photo Contest (“the Contest”). Employees of AAA Northern New England, LLC (“AAA Northern New England” or “Sponsor”), and its affiliated clubs, affiliates, subsidiaries, and related companies, participating promotional vendors (and their affiliates, subsidiaries, and related companies), and service providers and their respective immediate families (as well as household members of each, whether related or not), are ineligible. The Contest is open to both amateur and professional photographers. Void outside of Maine, New Hampshire, and Vermont, and wherever prohibited by law.

2. CONTEST DEADLINE
The Contest commences at noon EST, February 21, 2020, and is limited to the first 10,000 submissions received by 11:59 p.m. EDT, June 1, 2020. Sponsor’s computer is the official timekeeping device for the contest. Winning entries will be published in the November/December 2020 issue of Northern New England Journey magazine.

3. ENTRY
Submit one digital photograph of natural beauty from any of the 50 states or the District of Columbia. Subject to the rules below, this could include landscapes, wildlife, and/or other unique scenes. Limit one entry per household. Please also follow the submission guidelines in Section 5 below.

New for 2020: Photographs made by using drone-mounted equipment are no longer permitted.

Note: Photos that require the use of a model release for identifiable people or any other type of release for any copyrighted subject owned by others (as determined by Sponsor in its sole discretion) will be disqualified.

By entering this Contest, you agree to abide by its rules and to accept the judges’ decision as final. By entering this Contest, you also warrant and represent to Sponsor that your entry: (a) is your original work, (b) has not been previously published, (c) has not won previous awards, (d) does not infringe upon the copyrights, trademarks, rights of privacy, publicity, or other intellectual property or other rights of any person or entity, including as a result of publication of your entry via various media including print and web posting, and you will indemnify, defend, and hold harmless Sponsor from any claims to the contrary.

By entering this Contest, you understand and agree that you may be required to authenticate your entry as your own original work, using a method to be determined by Sponsor in its sole discretion. Such methods include, but are not limited to, the provision of metadata; the original image, slide, or negative; and/or answers to such questions as how you set up the shot.

In addition, by entering this Contest, you understand and agree that submission of any entry which violates any of the above representations and warranties may result in forfeiture of an awarded prize and cancellation of the Entrant’s AAA Northern New England membership.

You further agree, and represent and warrant to Sponsor, that your entry meets these standards of photo manipulation: This Contest accepts color and monochrome digital images that have been created by the Entrant with any device, including smartphones and still cameras (including medium- and large-format cameras). Images may be from single capture or stitching software, film, or digital capture, but must be 100 percent photographic in origin. Images that have been retouched by the Entrant using software, a camera app, a photo-editing app, or by other means will be accepted, but excessive manipulation may be scored down by the judges. Computer-generated images and elements are not permitted. Rule of thumb: While digital manipulation is permissible, it should be limited to cropping and/or minor burning, dodging, and/or color correction. Photo editing tools should not be used to remove, add, or rearrange elements. Any changes to the original photograph not itemized here beyond what is necessary to conform to the required file guidelines for entry will render the photograph ineligible for a prize.

Submission of an entry and/or acceptance of a prize grants AAA Northern New England and third parties authorized by Sponsor the exclusive, perpetual right to publish, use, edit, adapt, modify, excerpt, and/or copy the entry for any and all purposes in any and all media currently in existence or hereafter developed without compensation to the Entrant, which includes, but is not limited to, the right to publish the entry in Northern New England Journey magazine, on AAA.com (including any other related websites and social media platforms), and to use the entry as we see fit in exhibitions and promotions of Northern New England Journey magazine.

Submissions may not:
• Contain material that violates or infringes another’s rights, including but not limited to privacy, publicity, or intellectual property rights;
• Contain material that is violent, inappropriate, depicts nudity, or is indecent, obscene, hateful, tortious, defamatory, slanderous, or libelous;
• Contain material that promotes bigotry, racism, hatred, or harm against any group or individual, or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age;
• Contain material that promotes any illegal activities or any other activity that may appear unsafe or dangerous;
• Contain material that promotes any particular political agenda or message;
• Contain material that is unlawful, in violation of or contrary to the laws or regulations in Maine, New Hampshire, or Vermont, or in any state where it was created;
• Contain any materials relating to lotteries, gambling, tobacco, alcohol, drugs, firearms/weapons, or any activities that may appear unsafe or dangerous;
• Contain material that defames, libels, misrepresents, or is negative about Sponsor or its products, or other people, products, or companies;
• Contain trademarks, logos, or trade dress owned by others or advertise or promote any brand or product of any kind, without permission, or contain any personal identification, such as license plate numbers, personal names, email addresses, or street addresses;
• Contain copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies, or other media or musical "samples") without permission; 
• Contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, or otherwise constitute an invasion of privacy or publicity rights;
• Communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate;
• Constitute in itself, a violation of law.

Submissions are the views/opinions of the individual Entrant and do not reflect the views of Sponsor in any manner.

WHEN CREATING A SUBMISSION, ENTRANTS SHALL NOT: (A) PUT THEMSELVES OR ANY OTHER PERSONS IN DANGER OF ACTUAL BODILY INJURY OR DEATH, OR (B) VIOLATE LAW. ANY SUBMISSION THAT, IN SPONSOR’S SOLE DISCRETION, VIOLATES EITHER PROHIBITION IN THE FOREGOING SENTENCE SHALL BE DISQUALIFIED.

4. PRIZES

Prizes will be distributed on or after October 15, 2020.

First Prize (1): One-way travel for two and a car on Bay Ferries Limited’s The CAT; one-way travel for two and a car on Bay Ferries Limited’s Fundy Rose; two (2) nights’ stay for two in a Deluxe room at the AAA Four Diamond Harborside Hotel, Spa and Marina in Bar Harbor, Maine; two (2) nights’ stay for two in an Algonquin Queen room at the AAA Four Diamond The Algonquin Resort in St. Andrews-by-the-Sea, New Brunswick; three (3) nights’ stay for two in a Deluxe room at the Digby Pines Golf Resort and Spa in Digby, Nova Scotia; one (1) full-day electric bike rental for two from Pedego Acadia in Bar Harbor; and one (1) $100 Best Western Travel Card®. Estimated retail value: $3,289.

Second Prize (1): Two (2) nights’ stay for two at the AAA Four Diamond Hanover Inn Dartmouth in Hanover, New Hampshire, with a dinner for two at Pine; two (2) spots in baking classes at the King Arthur Flour Baking School in Norwich, Vermont; two (2) tickets to an Opera North performance of the winner’s choice at Blow-Me-Down Farm in Cornish, New Hampshire; admission for two to Saint-Gaudens National Historical Park in Cornish; and one (1) $50 Best Western Travel Card®. Estimated retail value: $1,268.

Third Prize (1): Two nights’ stay for two at the Hyatt Regency Boston Harbor and one (1) $50 Best Western Travel Card®. Estimated retail value: $750.

Honorable Mention (up to 10): Two (2) one-day admission tickets to the 2021 League of New Hampshire Craftsmen Annual Craftsmen’s Fair in Newbury, New Hampshire and a one-year AAA Northern New England membership with Classic benefits. Estimated retail value: $60–$82 each.

Taxes, if any, are the responsibility of the winners. Winners, as applicable, will be issued IRS Form 1099. Airfare and other transportation, baggage fees, taxes, fees, gratuities, and all other expenses not expressly specified herein are the responsibilities of the winners. No prize substitutions will be allowed except by AAA Northern New England, if, in its sole and absolute discretion, it determines that a prize component is not reasonably available, in which case a prize of equal or greater value will be awarded. Prizes, including, but not limited to, hotel nights and airfare, are non-transferable, non-refundable, not redeemable for cash, and may not be sold. Certain other restrictions may apply. AAA Northern New England acts only as an agent for the various providers listed.

FIRST PRIZE

Bay Ferries Limited: Prize includes one-way passage on The CAT ferry between Bar Harbor, Maine, and Yarmouth, Nova Scotia, and one-way passage on the Fundy Rose ferry between Saint John, New Brunswick, and Digby, Nova Scotia, for two adults in a regular passenger vehicle (under 6 feet, 6 inches in height and less than 20 feet long). Travel is meant to be taken as a one-way loop; the clockwise or counterclockwise direction of the route is at the winner’s discretion. Prize is non-transferable and may not be combined with any other offers. No cash value. Prize is valid during the 2021 season. Advance reservations are required and select blackout dates may apply. Harborside Hotel, Spa and Marina: Prize includes two (2) nights’ stay for two in a newly renovated Deluxe room with complimentary parking, Wi-Fi, and daily breakfast for two. Taxes are included. Pedego Acadia: Prize includes a full-day Pedego electric bike rental for two with a day pass to Acadia National Park. A detailed map of the park’s scenic 21-mile loop, refreshments, and helmets will be provided. Reservations are required (call 207-664-9181 at least one week in advance to schedule) and are based on availability between April 1, 2021, and October 25, 2021. SECOND PRIZE

Hanover Inn Dartmouth: Prize includes two (2) nights’ stay for two in a Junior Suite with breakfast at the Hanover Inn Dartmouth in Hanover, New Hampshire. Prize includes dinner for two at PINE Restaurant and daily breakfast for two (alcoholic beverages are not included). Prize includes tax, Wi-Fi, and parking. Incidentals, additional services, and gratuities are not included. Reservations are required for hotel room and are based on availability, subject to blackout dates, which may include, but are not limited to, Dartmouth Commencement and Homecoming. King Arthur Flour Baking School: Prize includes two (2) tuitions at 2021 baking courses offered by the King Arthur Flour Baking School in Norwich, Vermont. Options include two people in the same course, two people in different courses, or one person in two courses. Courses are open to participants of any skill level and last for up to four hours. Please register early as class space is limited and classes often sell out. Certificate covers up to $220 worth of tuition in three- or four-hour courses; winner may book other courses but will be responsible for any additional costs, which are payable at the time of booking. Opera North: Opera North typically presents three sets of shows each summer at Blow-Me-Down Farm, a part of the Saint-Gaudens National Historical Park in Cornish, New Hampshire. Titles and dates are announced each spring. Tickets are valid for the winner’s choice of performances during the 2021 season. For more information, visit operanorth.org.

Saint-Gaudens National Historical Park: The park is fully open daily from the Saturday of Memorial Day weekend through October 31; the visitors center is typically open Monday–Friday during the rest of the year. THIRD PRIZE

Hyatt: Prize is provided in the form of $700 worth of Hyatt Gift cards. Use of this card constitutes acceptance of terms. Certain purchases (e.g., hotel stays) may have a minimum age requirement. Card may not be used outside of North and South America. HONORABLE MENTION

League of New Hampshire Craftsmen: Prize includes two (2) one-day admission tickets. The 2021 Craftsmen’s Fair takes place at the Mount Sunapee Resort in Newbury, New Hampshire, from August 7 through August 15, 2021. For more information, see nhcrafts.org.

AAA Northern New England: Prize includes a one-year membership with Classic benefits. Winner may apply value of the membership prize toward renewal of next year’s dues, pursuant to the following: If the AAA Northern New England membership is set to expire prior to or close to the approximate prize distribution date of October 15, 2020, you are advised to pay your renewal on time; AAA is not responsible for providing member services and benefits if your membership expires before you receive your award. Your award of a one-year Auto Club membership with Classic benefits may be applied to your account as a credit, redeemable at the subsequent renewal. If your household carries AAA Plus or AAA Premier benefits, the award value of Classic benefits ($52) will be applied to your bill for the year; in this case, you would need to pay the outstanding balance to maintain the Plus or Premier benefits, as well as any associate memberships. If the prizewinner is an associate member, the associate membership value ($30) will be applied toward the renewal dues of his or her sponsoring primary membership holder.

5. SUBMISSIONS
The competition is open to original, unpublished work created by the Entrant from June 1, 2019, through June 1, 2020. Entries may be submitted pursuant to the following guidelines:

File specifications: Submissions should be in JPG or JPEG format. Files should have a long dimension of at least 2,000 pixels (roughly 7 inches), and be saved at a minimum of 300 dpi.

Simple file names are best; spaces, slashes, or other odd characters may cause difficulties with the hosted contest site. File names must have the .jpg or .jpeg extension.

Submitting the entry: Enter by filling out all fields and uploading your photo on this website. Entry is only possible through this website. Entry is not possible by post, courier service, email, or any other method of delivery.

Follow on-screen instructions carefully, and note that there are several pages of information to complete. Use the “Save and Next” buttons at the bottom of each page to progress through the pages. When you are satisfied with the information you have provided, click “SAVE AND FINALIZE” on the final page to complete your entry.

Your entry is not complete and cannot be judged until you click the “Save and Finalize” button. An on-screen message and a confirmation email will signify that your entry has been completed successfully.

All entries become the physical property of AAA Northern New England and will not be returned. All entries will be used by Sponsor in accordance with its privacy policy, which is at https://www.northernnewengland.aaa.com/legal/privacy.html. The Entrant should be aware that Sponsor may be collecting nonpublic, personally-identifiable information about such Entrant in connection with the operation of the Contest, and each Entrant hereby agrees to permit Sponsor to use such information as described in Sponsor’s Privacy Policy.

NOTE: Entries made in any manner inconsistent with these Official Rules will be declared invalid and disqualified from this Contest. By submitting an entry, you thereby affirm that you have read and agree to these Official Rules.

6. JUDGING/WINNERS
Members of the Northern New England Journey editorial and design staffs will judge the entries based on creativity, technical expertise, and aesthetic value. The decision of the judges is final. Judging will commence at 3333 Fairview Road, Costa Mesa, CA 92626-1698, during or after the week of June 7, 2020.

Winners will be notified via phone and/or email on or after June 15, 2020 and by July 2, 2020. Winners will be required to sign and return an Affidavit of Eligibility, Publicity, Liability, and Grant of Rights to Sponsor. All forms, without any alteration, must be received by us within thirty (30) days of the date of delivery of notification to a potential winner, or alternate winners will be selected; provided, that under no circumstances shall Sponsor be required to make more than three (3) attempts to award a prize.

By entering this Contest and/or accepting a prize, you agree to allow AAA Northern New England to use your name, voice, and image in connection with publication of your winning entry, and for promotional purposes (as described in Section 3 above) without review, notification, or approval.

7. MISCELLANEOUS
This Contest is subject to all federal, Maine, New Hampshire, Vermont, and local laws, and is void where prohibited. Winners agree that AAA Northern New England and prize contributors, including their parents, subsidiaries, affiliates (and related companies), officers, directors, and employees, shall not be liable for injury, loss or damage of any kind resulting directly or indirectly from the Entrant participating in this Contest or from the acceptance or use of any prize awarded (including any Entrant’s guests), or from use of their names, photographs, and/or likenesses for advertising and publicity purposes without any compensation and upon request, will provide written consent to such use (“Release”). Any guest accompanying the winners will be required to sign and return a release of liability/publicity within a specified time. Failure to return documents in a timely manner or the return of prize notification as undeliverable will cause Prize(s) to be forfeited. AAA Northern New England reserves the right to verify eligibility qualifications of any winner(s). Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the website, AAA.com/photocontest, or who is otherwise in violation of the Official Rules. Sponsor further reserves the right to cancel, terminate, or modify the Contest if it is not capable of completion as planned, or for any other reason, including, but not limited to, for example, infection by a computer virus, bugs, tampering, unauthorized intervention, or technical failures of any sort. In the event of early termination of the Contest, winners will be selected from all eligible entries received at the time of termination in accordance with the judging procedures described above. In no event will Sponsor be responsible for any damages or losses arising out of access to and use of the website, or the downloading from and/or printing material downloaded from said site.

Sponsor is not responsible for lost, late, incomplete, illegible, or misdirected entries, nor is it responsible for incorrect or inaccurate information utilized in the Contest. Receipt of entries cannot be confirmed. In the event of a dispute concerning the identity of a person submitting an online entry, the entry will be deemed submitted by the person in whose name the email account is registered.

All decisions and/or actions by Sponsor shall be exercised in its sole and absolute discretion.

8. GOVERNING LAW: CONSENT TO JURISDICTION
The Contest shall be governed by the laws of the State of Maine without regard for choice of laws or conflicts of laws principles. Any and all disputes or claims arising out of or connected in any way with the Contest will be resolved individually and exclusively by final and binding arbitration administered by the American Arbitration Association (the “AAA”) and conducted before a sole arbitrator pursuant to the Code of Procedure established by the AAA. The arbitration shall be held in Cumberland County, Maine. The arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules. There shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only the Entrant’s and/or Sponsor’s or a prize provider’s individual claims and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; provided, however, that if this sentence is declared invalid or unenforceable, either in whole or in part, the remaining sentences of Section 8 shall remain in full force and effect. The arbitrator shall not have the power to award special, consequential, incidental, exemplary, punitive, or other similar damages against Sponsor or any prize provider. If any part of this arbitration provision is deemed to be invalid or otherwise unenforceable or illegal, the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein, except that any such invalid or illegal provision shall be enforced to the greatest extent permitted by law. Notwithstanding anything contained herein to the contrary, Sponsor or any prize provider may seek to obtain injunctive relief against an Entrant for the breach or threatened breach of these Official Rules, without posting bond, in addition to any other remedies in law or equity, which may be available to Sponsor or prize provider, in any of the federal or state courts located in Cumberland County, Maine. Each Entrant consents to jurisdiction and venue in the federal or state courts located in Cumberland County, Maine, for the purposes set forth above and/or to confirm any award obtained by Sponsor or a prize provider in arbitration.

9. WINNERS LIST
A winners list will be available upon request once the November/December 2020 issue of Northern New England Journey is released. Send a self-addressed, stamped envelope to AAA Northern New England, Photo Contest 2020, P.O. Box 3544, Portland, ME 04104-3544. Requests must be received by January 31, 2021.
